The following will be considered at the Regular Meeting of the Doña Ana County Board of County Commissioners to be held on Tuesday, June 14, 2016 at 9:00 a.m. in the Doña Ana County Commission Chambers, 1st Floor, Doña Ana County Government Center, 845 North Motel Boulevard, Las Cruces:

THE DOÑA ANA COUNTY BOARD OF COUNTY COMMISSIONERS RECONVENES AS THE COUNTY CANVASSING BOARD IN OPEN SESSION to complete the canvass of the returns and declare the results of the election held on Tuesday, June 7, 2016, and certify the election results, as provided for by the New Mexico Election Code, NMSA 1978 §1-13-13.

· The Board of County Commissioners will reconvene as the County Canvassing Board to complete the canvass of returns and declare the results of the Primary Election held on Tuesday, June 7, 2016, and certify the election results to the Secretary of State consistent with the provisions of the New Mexico Election Code, Sections 1-13-1 et seq. NMSA 1978.

· The County Board of County Commissioners adjourns as the County Canvassing Board

3. Proclaim June 19, 2016 as Juneteenth Freedom Day in Doña Ana County – Julia T. Brown, County Manager, will read the Proclamation.

CONSENT AGENDA - The Board will be asked to approve by one motion the following items of recurring or routine business:

Resolution Approving Agreement Between the New Mexico Department of Transportation and Doña Ana County for Purchase of Drainage Easement Along NM460 (Anthony Dr.) in Anthony, and Delegating Signature Authority on Agreement and Related Documents, and the Authority to Approve Changes to the Agreement Required by the New Mexico State Board of Finance, to County Manager – Armando Cordero, Director, Facilities and Parks, will discuss.

5. Approve Award of Request for Proposal 16-0045 Bank Depository Services and Delegate Signature Authority to the County Manager for Related Contract Documents – David Gutierrez, Treasurer, will discuss.

6. Approve Sole Source Contract to Evoqua Water Technologies for Odor Abatement Services, and Delegate Signature Authority to the County Manager on all Related Documents – Nora Oliver, Office Supervisor, Utilities Department, will discuss.

7. Approval of Sealed Bid #16-0036 to Bixby Electric, Inc. for Construction and Installation of an Automated Weather Observation System (AWOS) for the Jetport, and Delegate Signature Authority to the County Manager on Related Contract, Amendments and Change Orders – Bill Provance, Jetport Manager, will discuss.

8. Approve a Contract for Fiscal Year 2017 in the Amount of $130,000 with NMSU Cooperative Extension Services and Delegate Signature Authority to the County Manager for all Related Contract Documents – Jamie Michael, Director, Health and Human Services, will discuss.

9. Approve Award of a Contract for Fiscal Year 2017 with Technical Resource Management, Inc. DBA Cordant Forensic Solutions or Norchem (TRM) in the Amount of $60,000 for the Provision of Drug Testing Services and Delegate Signature Authority to the County Manager for all Related Contract Documents – Jamie Michael, Director, Health and Human Services, will discuss.

10. Accept and Approve Award for the State of New Mexico, New Mexico Tourism Department Litter and Beautification Grant Agreement (No. 17-418-6002-0017) and Delegate Signature Authority to the County Manager to Amend and Renew all Related Documents – Vicki Lusk, Manager, ACO/Codes, Community Development, will discuss.

APPROVALS

11. Approve a Resolution Amending the Human Resources Policies and Procedures Originally Adopted May 28, 2008, Amended June 9, 2009, May 25, 2010, and May 24, 2011, and December 9, 2014 – Deborah Weir, Director, Human Resources, will discuss.

12. Report of Annual Inspection of the Doña Ana County Detention Center Conducted by Commissioners Hancock and Rawson – Nelson Goodin, County Attorney, will discuss.

13. Appoint Applicant for Vacancy on the Doña Ana County Americans with Disabilities Act Advisory Committee (ADAAC) – Meg Haines, EEO Specialist/ADA Coordinator, Human Resources Department, will discuss.

PUBLIC HEARING/ORDINANCE

14. Approve an Ordinance Amending the Code of the County of Doña Ana, by Deleting and Repealing §207-8 Thereof, Basis for Establishing Areas of Special Flood Hazard, and Replacing it with a New §207-8, To be Entitled Basis for Establishing Areas of Special Flood Hazard, which Section Provides for the Effective Date of FEMA’s Scientific and Engineering Report to Include Flood Insurance Rate Maps and Flood Boundary Floodway Maps – Paul Dugie, Director, Flood Commission, will discuss.

CORRESPONDENCE

15. Lynn Ellins, County Clerk, will present to the Commission any claims received by Doña Ana County.

THE DOÑA ANA COUNTY BOARD OF COUNTY COMMISSIONERS MAY CONVENE IN CLOSED SESSION subject to the attorney-client privilege to discuss threatened or pending litigation regarding City of Las Cruces and County of Doña Ana v. Travelers Indemnity Co., et al., No. 2:14-CV-00931-MV-LAM; regarding Provisional Government of Santa Teresa and Mary Gonzalez v. Doña Ana County Board of County Commissioners, D-307-CV-2015-02653; and regarding Hiles v. Enriquez, et al., CV-2016-01052; and to discuss a limited personnel matter regarding the County Manager’s performance evaluation; and to discuss bargaining strategy preliminary to collective bargaining negotiations between Doña Ana County and ASCME Court Security, AFSCME Detention Center, and International Association of Fire Fighters Local 5037 bargaining units; all as authorized by the Open Meetings Act, NMSA 1978, §10-15-1 (H) (7), (2), and (5), respectively.
