6. Case # SU08-004/SMELSER: The applicants, Steve & Margaret Smelser, are requesting a Special Use Permit within the ER2 Zoning District (Residential, 2-acre minimum new lot size, single-family site built homes) to construct and operate a commercial dog and cat kennel business (Animal Haven Lodge & Salon) on a 1.085-acre parcel. The business is at 3027 N. Valley Dr., within Section 2, T23S, R1E, and can be further identified by Map Code # 4-005-133-213-178.

7. Case # SU08-005/RITCHEY: The applicants, Samuel & Nancy Ritchey, are requesting a Special Use Permit to expand the facilities of the Wellspring Church. A 5,293 sq. ft. chapel and portico are proposed and the existing 1,212 sq. ft. chapel will be converted into multi-use facilities. The church was granted a Special Use Permit in 1995 (Case # SU95-009). The 3.0-acre subject parcel is north of the City of Las Cruces, west of El Camino Real, at 140 W. Taylor Rd., and is located within Sections 23/26, T22S, R1E, and can be further identified by Map Code # 4-005-131-345-028.

8. CASE #Z08-001/BIAD CHILI LTD.: The applicant, Biad Chili Ltd., is requesting a Zone Change on a 5.46-acre parcel from ER3 (Residential, one-acre minimum new lot size, single-family site-built homes) to EI2 (General industrial, 5,000 s.f. minimum new lot size), for the purpose of building a 1000 sq. ft. expansion to the existing building for a seasonal (Oct.- Dec.) food processing business. It currently has a legal non-conforming status. The subject parcel is located south of the city of Las Cruces at 6060 South Main St. in Mesilla Park within Section 9, T 24S, R2 E, and can be further identified by Map Code # 4-009-140-280-290.

9. Review of a Proposed Modification to Amendment 2007-01 to the Las Cruces Extra-Territorial Zoning Ordinance (No. 88-02), Article VIII, “Keeping of Animals.” The ETZ will make a recommendation to the ETA on this issue.
